1. WHAT SERVICES DO THESE TERMS COVER?
These terms and conditions of use cover all content, products and services, however, accessed and/or used, which are operated and made available by Sisanda Tech (PTY) Ltd.
2. THIS IS AN AGREEMENT BETWEEN YOU AND SISANDA TECH (PTY) LTD.
2.1. By accessing our content, downloading or using any of our products and services, you acknowledge that you have read, understood and consented to these terms and conditions and any code of conduct that we may put forward. You further understand and consent that by permitting a child to access our content, download and use our products and services, you are also agreeing that the child will also adhere to these terms and conditions.
2.2. By agreeing to be bound by these terms you also agree that you have also read, understood and consent to the terms of our privacy policy.
2.3. We may update these terms of use at any time. Your continued use of our products and services will be deemed to mean that you have accepted the modifications that we may make.
3. INTELLECTUAL PROPERTY, SERVICE CONTENT AND USER SUBMISSIONS
3.1. All content on our website and applications as well as all other services including articles, artwork, screenshots, graphic logos, downloads and other files are the property of Sisanda Tech (Pty) Ltd.
3.2. You hereby acknowledge and accept that you have no property rights or any other rights in any content in our services including but not limited to content that you may have developed or created on our website or in our applications.
3.3. Any advice, opinions or other information expressed by third parties on the services provided by Sisanda Tech represent the views of those third parties and neither Sisanda Tech nor any of its affiliates, agents, directors, employees or information providers shall be responsible or liable for any decisions that are made based on such information.
4. USER RIGHTS AND RESTRICTIONS
4.1. These terms and conditions grant permission to:
4.1.1. A user in his or her individual capacity and/or on behalf of their child;
4.1.2. Educational institutions and their employees for use in their official capacities as teachers, assistant teachers, student teachers, tutors and all other official capacities afforded to them by the institution for educational purposes only.
4.2. In no instance may the above-permitted users:
4.2.1. Change or remove any propriety notices from the content on any of our services;
4.2.2. Modify or create works based on our content;
4.2.3. Use or facilitate the use of unauthorized third-party software to modify or automate any operation within or website or mobile applications and services for any reason;
4.2.4. Use our content in a manner which suggests associations with other products, services or brands:
-Without our explicit consent;
-In a way that is likely to cause confusion among customers;
-In a way that disparages or discredits Sisanda Tech;
-In a way that is exploitive for any commercial purpose; and
-In any other way which infringes on our intellectual property rights;
4.2.5. Download quantities of our content to a database for any reason unless it is with our prior consent
4.2.6. Use any of our content, products or services for any reason other than those which have been provided by us with the operation of this service.
4.2.7. Develop any product or service which is functionally similar to that of Sisanda Tech;
4.2.8. Use any of our products or services for the benefit of any third party or transfer their access to our services and products to a third party;
4.2.9. Without our explicit consent use our content, products or services for commercial purposes including but not limited to:
– Placing advertising, sponsorship, or promotions on or within our content, products or services,
-Use our logo or designs or any part thereof as well as any other images which are associated with our brand to promote any third- party products, services content or events;
4.2.10. Infiltrate any system used to operate our products and services
4.2.11. Undercut or disable any security or digital rights management
4.2.12. Take any action to cause or exploit any known or latent malfunctions, bugs or other defects in the content, product, service or system used by us to provide our services
4.2.13. Attempt to undercut any restrictions we have placed on any of or services based on age, privacy or any other restriction imposed by us
4.2.14 Republish, sell, rent, sub-licence, reproduce, duplicate, copy, redistribute or exploit our content, products or services.
4.3. Where our content or products have been specifically made available for redistribution, they may only be redistributed within our organisation.
4.4. Furthermore, you agree to comply with all applicable laws and legal obligations including but not limited to those pertaining to copyright, trademark and other intellectual property laws, defamation, the right to privacy and laws of delict. Violation of applicable laws may give rise to civil and or criminal prosecution and penalties.
4.5. You acknowledge that you are solely responsible for maintaining the confidentiality of all the account information and login details that you use in connection with our products or services.
4.6. You agree that Sisanda Tech will not be responsible for any losses arising out of any and all unauthorized use of your Sisanda Tech account.
4.7. You acknowledge that we may at any time, with or without notice, suspend or terminate your access to some or all of our service and refuse you any and all current or future use of the service at any time.
5. CONDUCT AND COMMUNITY STANDARDS
5.1. You are prohibited from using our content, products or services in any way which could:
– Interfere with anyone else’s use and enjoyment of our content, products or services;
– Be received as abusive, illegal, indecent, obscene, vulgar, offensive or threatening;
– Encourage anyone to break the law;
– Violate anyone’s property rights;
– Interfere with the privacy of other users;
6. USER CONTENT
6.1. Your user content refers to the materials that you may submit to us when using our website, applications or other services.
6.2. You user content must not be illegal or unlawful in any way.
6.3. Sisanda Tech reserves the right to edit or remove any material submitted, stored or published on our website or applications.
6.4 Notwithstanding Sisanda Tech’s rights under these terms and conditions, Sisanda Tech does not undertake to monitor the submission of such content to or the publication of such content on this website.
7. LIMITATIONS OF LIABILITY
7.1. Sisanda Tech will not be liable to you in relation to the contents of, or use of, or otherwise in connection with our website, applications, products or services for any direct loss; for any indirect, special or consequential loss.
7.2. The above disclaimer in 7.1. remains subject to any warranties which are implied or included by law.
8. BREACH OF TERMS AND CONDITIONS
Without prejudice to Sisanda Tech’s rights under these terms and conditions, if you breach these terms and conditions in any way, Sisanda Tech may take such action as it deems appropriate to deal with the breach, including but not limited to suspending your access to our content, products and services; prohibiting you from accessing our website and applications; blocking computers using your IP address from accessing the website and/ or bringing court proceedings against you.
9. ORDERS AND SALES
9.1. Users may place orders for products and Sisanda Tech reserves the right to accept or reject such orders. Whether or not Sisanda Tech accepts an order will depend on the availability of the products, the correctness of the information relating to the products and receipt of payment or payment authorisation of the products by Sisanda tech.
9.2. Orders may not be cancelled after receipt of payment for the goods by Sisanda Tech. After the dispatch and the delivery of your goods, you may only cancel the sale in accordance with our returns policy.
9.3. Placing Goods in a shopping basket without completing the purchase cycle does not constitute an order for such goods or the conclusion for the sale thereof and as such, selected goods may be removed from the shopping basket if stock is no longer available. You cannot hold Sisanda Tech liable if such goods are no longer available at the time that you choose to complete the purchase.
9.4. Where goods become unavailable after you have placed your order, Sisanda Tech will notify you and you will be entitled to a refund of the amount you have paid for such goods.
10. PAYMENT
10.1. We prioritize providing you with secure online payment options. All transactions are secured with advanced encryption technology.
10.2. Payment can be made for goods via-
10.2.1. Credit card: where payment is made by credit card we will require additional information in order to authorise and/or verify the validity of the payment and in such cases we reserve the right to withhold delivery until such time as the additional information is received by us and authorization is obtained by us for the amounts.
10.2.2. Instant EFT; where payment is made by instant EFT you will be directed to your banking page where you will be required to input your internet banking details to logon to your internet banking and make an electronic funds transfer which will be verified instantly.
10.2.3. Paypal: where payment is made by Paypal, you will be required to input your Paypal login details (email address and password) and select the bank account or debit card that you wish to use for payment from your Paypal account.
10.3. You may contact us via email at baso@sisanda.net to obtain a full record of your payment. We will also send you email and sms communication about your order and payment.
10.4. Once you have selected your payment method and have accepted these Terms and Conditions, you will be directed to a link to a secure site for payment of the applicable purchase price for your goods.
11. DELIVERY OF GOODS
11.1. Sisanda Tech offers free delivery on the purchase of all goods.
11.2. Delivery of goods is executed only via courier.
12. RETURNS
12.1. In general, you can return an unwanted product to us at no charge, provided:
– It is undamaged and unused with the original labels and stickers attached;
– It is in the original packaging, which must be undamaged and in its original condition;
– It is not missing any accessories or parts
– That the reason for return is where specifications of a product, although accurately described in the website and application generally fit for its intended purpose, do not suit you.
– You log a return via email at baso@sisanda.net within 30 days of delivery to you. After the 30day period has passed you can only return the product if it is defective within 6 months from delivery provided that the defect is not due to normal wear and tear or caused by your own negligence;
12.2. Where the product is already damaged at the time of delivery, you must notify us within 7 days of receiving the goods by logging a return via email at baso@sisanda.net with relevant proof (e.g. a photograph of the products and packaging upon opening the package delivered to you). We will then arrange for collection of the product at no extra charge and repair/replace the product as soon as possible; or credit your account with the purchase price of the product.
12.3. Once you have logged a return of a product via email, we will liaise with you to have the product collected from you or couriered back to us at no extra charge. Our courier will, however, be entitled to refuse collection of the goods or products are not properly packaged for transport.
12.4. Once we have inspected the product and validated your return, we will credit your account with the purchase price of the product within 10 working days of the return.
12.5. We are entitled to refuse a return if the unwanted product is returned to us damaged or no longer in a condition to be re-sold.
13. EXCHANGES
13.1. Our clothing items may be exchanged for different sizes provided that such variation is available and is available at the same price as the item was originally purchased. In that event, we will collect the item from you and deliver the requested product variation to you at no charge.
13.2. If the desired variation you require is not available we will credit your account with the purchase price of the product within 10 working days of you logging the exchange.
